Nothing confounds a road user than a horrific traffic accident that may result in serious and even fatal injuries. The truth of the matter is that notwithstanding that everybody leaves the house hoping to come back safely there are accidents that twist and turn the fate of the road user and find them wanting of acute medical and financial attention. Sincephetelo Motor Vehicle Accidents Fund was established for that purpose by Parliament Act NO: 13 of 1991 as amended by Act No: 20 of 2011 as instrument of Government to compensate victims of traffic accidents whose injuries and even death are a direct result of negligent driving of a motor vehicle. Therefore, for anyone who can point at an errant driver to have been the cause of their ill-fate in traffic, they stand a chance to lodge a claim with SMVAF for compensation. However, for that to happen, the accident in which the potential claimant was injured should have been reported to the nearest police station. This would result in the police collecting all pertinent details pertaining to the accident and issuing a police report therewith –on request by the injured party. Also it is imperative that the injured person seeks medical attention that would inform them on the intensity and gravity of their injuries.
THE CLAIMING PROCESS
Claiming for an MVA compensation commences with the injured party procuring a police report. They would submit that document in their first contact with the Fund and be advised on the nature and category of the claim. The Fund is going to issue a claim form and further detect the claim how to fill and complete same for admission. In the event a claimant was injured and survived an accident, there would be need that they also get a medical practitioner’s report inscribed and the back of the claim form so that the fund is acquainted not only with the nature of injuries sustained but also their intensity. For those claimants lodging claims on behalf of deceased relatives as a result of a traffic accident it is imperative that they would have submitted the body for forensic pathology so that the pathologist would confirm the demise as a direct result of an MVA. From same, there shall be a generation of a death certificate which plays a pivotal role in the commencement and processing of the lodged claim.
TYPES OF CLAIMS
There are three types of claims that can ensue from the injuries or even death people may incur in traffic accidents. The first one is Personal Injury Claim. These are claims where the victims would have survived the accident, treated in hospital and coming back to claim for the injuries and disabilities they may have suffered. There is also Funeral Expenses Claims lodged by close relatives of anyone whose injury in traffic has led to their demise and is followed closely (not in all Cases though) by a Loss of Support where legal dependents of the deceased may claim for monetary loss towards their upkeep suffered as a result of the demise of their loved.
