Why We Investigate!

After the submission and approval of the MVA Claim Form, the Motor Vehicle Accident (MVA) Fund conducts an independent investigation into the accident. This investigation is a crucial step in the claims process and is carried out by the Fund’s dedicated investigators. It is important to note that this process is separate from any police investigations conducted for criminal or litigation purposes.

As the insurer of the negligent driver or vehicle owner, the Fund’s investigation serves the following key purposes:

1. Verification of Accident Details

• The Fund assesses the circumstances of the accident to determine liability and validate the claim.
• This investigation does not imply criminal liability on the part of the negligent driver but ensures a fair compensation process.

2. Proof of Life/Existence (for Loss of Support Claims)

• In cases involving Loss of Support claims, the Fund requires tangible proof of the deceased’s earnings to assess financial dependency.
• Additionally, proof of the number of beneficiaries (dependents) must be provided to determine the rightful claimants.

3. Proof of Earnings & Incurred Loss

• The Fund investigates proof of earnings to establish the financial impact on the claimant (e.g., lost wages due to injury or death).
• For medical or funeral expense claims, proof of incurred loss (such as invoices, receipts, or medical reports) must be submitted.

4. Fair Compensation & Claim Resolution

• The investigation ensures that the Fund can assume the role of the negligent party and provide just compensation to accident survivors or dependents.
• This process is authorized under Section 4(a) of the Motor Vehicle Accident Fund (Amendment) Act, which empowers the Fund to conduct investigations for seamless claim processing.

The cooperation of the negligent driver(s) and all involved parties is crucial for an efficient resolution. By conducting this investigation, the Fund upholds its mandate to:
